1. Introduction

Welcome to HelloValet Pte Ltd ("Company," "we," "us," "our"). By accessing or using our drive-home service mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please discontinue your use of the App.

2. Definitions

2.1. Refers to the drive-home service provided through the App, where a driver ("Driver") is dispatched to transport users ("Customers") home in the Customer's vehicle.

2.2. "User" refers to anyone who downloads, accesses, or uses the App, including both Customers and Drivers.

2.3. "Service Fee" refers to the amount charged for the drive-home service.

2.4. "App" refers to the Hello Valet mobile application available on iOS and Android.

3. User Eligibility

3.1. Customer Eligibility:

  • Must be at least 18 years old.
  • Must possess a valid driver’s license in Singapore, be legally permitted to be transported, and ensure that their vehicle has valid insurance for the service period.

3.2. Driver Eligibility:

  • Must be at least 21 years old.
  • Hold a valid Singapore driver’s license with a minimum of two years of driving experience.
  • Maintain a clean driving record, with no major violations.
  • Ensure that the vehicle used for the Service complies with all applicable legal and safety requirements.

4. Service Description

4.1. Booking a Ride: Customers can request a Driver through the App. Once a request is made, the App will match the Customer with an available Driver based on proximity and other factors.

4.2. Driver Responsibilities: Drivers are responsible for transporting Customers safely to the requested destination and must ensure their vehicle is roadworthy and safe for use.
 

4.3. Customer Responsibilities: Customers must be punctual at the pickup location, ensure the vehicle is safe to operate, and maintain up-to-date payment information within the App.

5. Service Fees and Payment

5.1. Service Fees: Service Fees are calculated based on factors such as distance, time, and additional services. The total fee will be presented before the booking is confirmed.

5.2. Payment: Payments for the Service are processed through the App. Customers agree to pay all Service Fees, including any additional charges, using the payment method provided in their App account.

5.3. Refunds and Disputes: All payments are non-refundable unless otherwise specified. In the event of a dispute, Customers should contact us within 24 hours of the incident to resolve the issue.

6. User Conduct

6.1. Prohibited Conduct: Users agree not to:

  • Use the App for any illegal or unauthorized purposes.
  • Harass, threaten, or discriminate against Drivers or other users.
  • Engage in any behavior that could endanger the safety of the Driver, Customer, or other road users.
  • Provide false or misleading information in the App.

6.2. Consequences of Violations: Violations of these Terms may result in the suspension or termination of your account and legal action if applicable.

7. Privacy and Data Protection

7.1. Data Collection: We collect personal data, including but not limited to contact details, location data, and payment information, to provide and enhance our Service.

7.2. Data Usage: Personal data is used in accordance with our Privacy Policy, which outlines how we handle and protect your information.

7.3. Data Security: We employ commercially reasonable security measures to protect your personal data from unauthorized access or disclosure. However, no method of transmission over the internet or electronic storage is completely secure.

7.4. Compliance with PDPA: We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore, ensuring that your personal data is handled with due care and in accordance with applicable data protection laws.

8. Intellectual Property

8.1. Ownership: All content and materials in the App, including but not limited to text, graphics, logos, and software, are owned by the Company or licensed to us.

8.2. Restrictions: Users may not copy, modify, distribute, or create derivative works from any content in the App without our prior written consent.

9. Liability and Disclaimers

9.1. Limitation of Liability: To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, special, or consequential damages arising from or related to the use of the App or the Service.

9.2. No Warranty: The App and the Service are provided on an "as-is" and "as-available" basis. We do not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components.

9.3. Driver Liability: Drivers are independent contractors and are responsible for their own actions while providing the Service. The Company is not liable for any actions or omissions of Drivers.

10. Termination

10.1. Termination by Users: Users may terminate their account at any time by contacting us through the App or our website.

10.2. Termination by the Company: We may suspend or terminate a User’s account if they violate these Terms or engage in behavior that is harmful to the App, the Service, or other users.

10.3. Effect of Termination: Upon termination, your access to the App will cease, and you will no longer be able to use the Service. Termination does not relieve you of any obligations incurred prior to the termination.

11. Governing Law and Dispute Resolution

11.1. Governing Law: These Terms are governed by and construed in accordance with the laws of Singapore.

11.2. Dispute Resolution: Any disputes arising from or related to these Terms or the use of the App will be resolved through binding arbitration in Singapore, in accordance with the rules of the Singapore International Arbitration Centre (SIAC).

11.3. Class Action Waiver: Users agree to resolve disputes on an individual basis and waive any right to participate in class actions or representative actions.

12. Amendments to Terms

12.1. Modifications: We may update these Terms from time to time. The updated Terms will be effective when posted in the App or on our website.

12.2. Notification: Users will be notified of significant changes to these Terms. Continued use of the App after such changes constitutes acceptance of the modified Terms.

14. Miscellaneous

14.1. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.2. Entire Agreement: These Terms constitute the entire agreement between the User and the Company regarding the use of the App and supersede all prior agreements and understandings.

14.3. Assignment: The Company may assign its rights and obligations under these Terms without restriction. Users may not assign their rights or obligations without prior written consent from the Company.

14.4. Force Majeure: We are not liable for any failure to fulfill our obligations under these Terms due to circumstances beyond our control (e.g., natural disasters, government restrictions).
